Million pound settlement for young woman who suffered brain injury after being hit by a car

At age 25, Caroline was hit by a car when crossing the road on a night out with friends.

She was taken to hospital by ambulance and CT scans showed she suffered a severe brain injury.

As a result, she suffered personality change, behavioural problems and cognitive impairment to the extent that she needs a financial deputy to manage her finances and is unable to work.

The driver disputed the accident was his fault and blamed her for having had a few drinks and also argued that even if the car had been driving at a slower speed the collision wasn’t avoidable which complicated the issues.

Caroline was put under pressure by the defence insurers to settle for a low value. They arranged extensive covert surveillance of her day to day living and alleged she was exaggerating her difficulties.

The Defendants made an offer of £250,000 and several other low offers but we were able to eventually negotiate a settlement of £1.65 million (gross), over six times greater.

This substantial sum will ensure Caroline is financially secure and she can access the professional support she needs daily to avoid her becoming low in mood and vulnerable to those who might exploit her trusting nature. Her family have been steadfast in their love and support, sometimes to the detriment of their own health and now they can take a step back.

The case was tricky with all aspects disputed for several years but we obtained expert evidence in many areas to prove the driver was at fault and to show the court the true level of Caroline’s lifelong needs.
