Court of Protection explained
It is not something most of us want to think about, but if you suffered a serious brain injury or had an illness which impacted your capacity to manage your own finances, how would you or your family cope?
If you do not have a valid Power of Attorney in place, is likely that a Deputy would be appointed by the Court of Protection to manage your finances on your behalf by making best interest decisions subject to the Mental Capacity Act 2005.
Your Deputy will take on responsibility for managing your everyday financial decisions including:
- Paying your bills
- Claiming welfare benefits
- Investing money
- Budgeting for your future
- Buying and selling property
- Dealing with your tax affairs
