What is professional negligence?

Professional negligence cases are usually brought when a professional, such as a solicitor, has given a client substandard advice. To succeed in such a claim, you have to prove that:

  • You were owed a duty of reasonable care and skill
  • The duty has been breached
  • You have suffered loss and damage as a result

Our team specialises in challenging the advice of other solicitors in personal injury and clinical negligence claims and has a proven track record of success in doing so.

If you feel you have received bad advice from your solicitor and your case is continuing, we can often rescue the case, going on to succeed without you suffering any financial losses. We have substantial experience acting on behalf of clients in these circumstances.

Making your claim

Often, the substandard or negligent advice is not apparent straight away, and it is natural to consider that you instructed a professional in the first place because you were unable to do the job yourself. There is a large element of trust required when choosing a professional to act on your behalf.

However, despite the loss of trust and confidence, many people are reluctant to challenge or sue a solicitor and in our experience, this is quite normal. It is important, however, to bear in mind the rule that if a solicitor discovers they have been negligent, they are obliged to advise their client to “seek independent legal advice".

We are here to help

If your case has concluded but you feel you may have received negligent advice, we will be happy to look into your circumstances. We have often been successful in obtaining substantially more compensation than was originally awarded through the negligent professional. An example of this might be if a solicitor has advised a client to settle a claim for very little, either because they do not have the expertise required or have failed to investigate and gather the correct evidence.
