£2.85 million compensation secured for severe brain injury

Mark* was at work lifting a metal construction using an electric overhead travelling crane and a four-legged lifting chain which was positioned around the base of the load. He was struck on his left-hand side which caused him to fall and strike his head on a metal frame lying on the ground, sustaining a severe brain injury.

Mark has no recollection of the events leading up to and during the accident, nor the cause of the accident. He was taken to hospital and underwent a CT scan which showed major compound skull fractures.

Mark now requires assistance with many everyday tasks and suffers greatly from fatigue, anxiety and low mood. He also suffers from left-sided hemiplegia and so has no functional use of his left upper limb. Furthermore, his walking has also been affected and he now walks with a tripod.

We were successful in settlement of £2.85 million, subsequent to a joint settlement meeting (JSM) despite the Defendant’s approach throughout that no liability attributed to our client’s employers.
